Terms of Service

The agreement between you and Boqu Games when you play our games, use our website or contact our support team. Please read it, and especially the sections on virtual items and purchases.

The short version. Our games are social casino games only, for adults aged 18 and over, for entertainment. There is no real-money gambling. You cannot win real money or prizes. Chips, coins and other virtual items are a limited licence to use inside the games: they have no cash value, cannot be cashed out or sold, and purchases are final except where the law or the app store’s refund policy says otherwise. Play fairly, be kind at the table, and keep your account secure.

1. The agreement

These Terms of Service (“Terms”) are an agreement between you and Boqu Co., Ltd., which publishes games as Boqu Games (“Boqu Games”, “we”, “us”). They apply to our games, including Boqu Texas Hold’em Poker and Slots Palace, to our website at boqugames.com, and to our support and other related services (together, the “Services”).

By downloading, installing, accessing or using the Services, you agree to these Terms and to our Privacy Policy and Community Guidelines, which form part of these Terms. A game may also show its own rules, such as table rules or promotion rules; those rules apply too, and where they conflict with these Terms for that game or promotion, the game rules apply. If you do not agree, do not use the Services.

2. Who can play

You may use the Services only if:

  • you are at least 18 years old, or the age of majority where you live if that is higher;
  • you are legally able to enter into this agreement; and
  • social casino games are lawful where you live, and you are not barred from using the Services under any applicable law, including sanctions laws.

The Services are not directed to anyone under 18. If we learn that an account belongs to someone under 18, we will close it. Parents and guardians can find tools to manage a child’s devices and purchases on our Responsible play page.

3. Social casino only: no real-money gambling

Our games are social casino games only, provided for entertainment. They do not offer real-money gambling, and they do not offer any opportunity to win money, prizes or anything of value. You do not stake money on any outcome; anything you buy is a licence to virtual items, not a wager.

Practice or success at social casino games does not imply future success at real-money gambling. If you feel your play is no longer just for fun, please visit Responsible play.

4. Your account

Guest and registered accounts

Some games let you play as a guest without choosing a username or password. A guest account lives on your device: if you delete the game, reset or lose the device, the guest account and anything in it may be lost and we may not be able to recover it. Where a game offers it, you can save a guest account by registering a username and password, which keeps your progress and virtual items with the account rather than the device.

Keeping your account secure

You are responsible for keeping your login details confidential and for all activity in your account. Use a password you do not use anywhere else. Tell us promptly at [email protected] if you think someone else has accessed your account. We will never ask for your password by email or chat.

Usernames and display names

Choose names that follow our Community Guidelines. We may change or remove a name that does not, or that impersonates someone else.

Accounts are personal

Your account is for you alone. You may not sell, transfer, lend or share it, or buy or use someone else’s account. Accounts and the virtual items in them are not your property; see section 5.

Deleting your account

You can delete your account at any time from within the game, or as described on our Delete your account page. Deletion is permanent: virtual items, progress and history cannot be restored afterwards, and unused virtual items are not refundable.

5. Virtual items

Our games include virtual currencies such as chips and coins, and other virtual items such as boosts, passes, collectibles or cosmetic items (together, “Virtual Items”). Some you earn by playing or receive for free; some you can obtain with a purchase.

  • A licence, not property. When you obtain Virtual Items, we grant you a limited, personal, non-transferable, non-sublicensable, revocable licence to use them within the relevant game, for your own entertainment. You do not own Virtual Items, and no balance shown in a game is a balance of money or credit.
  • No cash value. Virtual Items have no monetary value. They cannot be cashed out, redeemed or exchanged for real money, goods, services or anything of value, from us or anyone else.
  • No trading outside the game. You may not sell, buy, trade, gift for value or transfer Virtual Items or accounts outside the features a game provides. The only place to obtain Virtual Items is inside our games. Offers anywhere else are not from us, and using them may lead to the loss of your account.
  • We manage the economy. We may manage, regulate, change or remove Virtual Items, including their price, availability, quantity and what they do, for example to keep the game balanced or to comply with the law. We are not liable to you when we do this, except where the law requires otherwise.
  • Loss of Virtual Items. Virtual Items may be lost if your account is deleted, suspended or terminated, if a guest account’s device data is lost, or if we discontinue a game. Unless the law requires it, we do not refund or compensate for Virtual Items in these situations. If we discontinue a game, we will give reasonable notice where we can.
  • Errors. If a Virtual Item balance is wrong because of a bug, outage or error, we may correct it, including by removing items credited by mistake.

6. Purchases

Where a game offers in-app purchases, you buy through the app store you downloaded the game from (for example, Apple’s App Store or Google Play). The store processes your payment under its own terms, and we never see your full payment card details. Prices are shown in the game and may vary by region and over time; taxes may apply.

  • Purchases are final. Except as required by law or by the app store’s refund policy, all purchases are final and non-refundable.
  • Refunds come from the store. Because the store takes your payment, refund requests go to the store you bought from. Apple and Google each provide a way to request a refund for in-app purchases.
  • Delivery. Virtual Items you buy are delivered to your account promptly after the store confirms the payment. If something you paid for has not arrived, contact us with your store receipt and we will look into it.
  • Right of withdrawal. If you live in the European Union, the United Kingdom or another place that gives consumers a right to withdraw from online purchases, you agree that we begin supplying digital content immediately on purchase, and you acknowledge that you lose your right of withdrawal once the content has been delivered.
  • Purchases by others. You are responsible for purchases made with your device and store account. Your device and store offer settings that require a password or approval for every purchase; see Responsible play.
  • Chargebacks. If a payment is reversed or charged back, we may remove the related Virtual Items and, in cases of abuse, suspend the account.

Some games may offer items with randomised contents. Where they do, the game will show the odds before you buy.

7. Fair play and game records

Game outcomes, such as the cards dealt or the result of a spin, are determined by our servers using random number generation, and each game action is confirmed by our servers before it counts. Our server records are the definitive record of what happened in a game, including hands, spins, balances and transactions.

To keep tables lively, some games may include automated players operated by us. Where they do, the game discloses this. Automated players follow the same rules as everyone else and have no access to hidden information.

If a malfunction, outage or error affects a game, plays and results affected by it may be void, and we may adjust balances to restore them to what they would have been. Lost connections can happen; where a game provides rules for disconnections (for example, folding or checking on your behalf), those rules apply.

8. Conduct

Treat other players with respect and follow our Community Guidelines. In particular, you agree not to:

  • cheat, collude with other players, chip-dump, or exploit bugs, and you agree to report bugs you find instead of using them;
  • use bots, scripts, automation, modified clients or any software that interacts with the Services in a way we have not authorised, or that gives an unfair advantage;
  • create or use multiple accounts to gain an advantage, to abuse promotions or free rewards, or to evade a suspension;
  • buy, sell or trade Virtual Items or accounts, or offer real-money side bets connected with any game;
  • harass, threaten, bully or abuse anyone, or post hateful, sexual, violent or illegal content;
  • impersonate Boqu Games staff or anyone else, or ask other players for their passwords or personal information;
  • interfere with, overload, probe, reverse engineer, decompile or disrupt the Services, or attempt to access them other than through the interfaces we provide, except where the law expressly permits it;
  • use the Services for any unlawful purpose or to promote any commercial product or service.

9. Chat and player content

Where a game includes chat, names, avatars or other ways to share content (“Player Content”), you are responsible for what you share. You keep any rights you have in your Player Content, and you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and moderate it as needed to operate, protect and improve the Services.

We may review, filter, hide or remove Player Content, mute or restrict chat, and keep records of messages and reports, including removed messages, to enforce these Terms and keep players safe. You can mute and report other players in the game. We do not endorse Player Content and are not responsible for it.

10. Our intellectual property

The Services, including our games, software, artwork, music, sound, text, characters, names, logos and trademarks, are owned by or licensed to Boqu Games and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use our games on devices you own or control, for your personal, non-commercial entertainment. All rights not expressly granted are reserved.

If you send us ideas or feedback, we may use them without obligation to you.

11. Changes to the games

Our games are live services that change over time. We may update, add, change or remove features, content, tables, slot games and Virtual Items, and we may require you to install updates to keep playing. We may suspend or discontinue a game, in whole or in part, with reasonable notice where we can. Features we describe as “in development” or “coming soon” are not guaranteed to be released.

12. Suspension and termination

You may stop using the Services and delete your account at any time. We may warn you, restrict features, suspend or terminate your account, or remove Virtual Items if we reasonably believe you have broken these Terms or the Community Guidelines, if required by law, or to protect players or the Services. Where appropriate, we will tell you why and give you a way to contact us about the decision. Sections of these Terms that by their nature should survive termination will survive, including sections 5, 6, 10 and 14 to 19.

13. App stores and Apple terms

Your use of a game is also subject to the terms of the app store you downloaded it from. If you downloaded a game from Apple’s App Store, the following also applies:

  • These Terms are between you and Boqu Games only, not Apple. Boqu Games, not Apple, is solely responsible for the game and its content.
  • Your licence to use the game is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  • Apple has no obligation to provide maintenance or support for the game. Support is provided by us, as described on our Support page.
  • To the extent any warranty applies to the game and the game fails to conform to it, you may notify Apple and Apple will refund the purchase price (if any) for the game. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the game.
  • Boqu Games, not Apple, is responsible for addressing any claims by you or any third party relating to the game or your possession or use of it, including product liability claims, claims that the game fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the game or your possession and use of it infringes that third party’s intellectual property rights, Boqu Games, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the game.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not promise that the Services will be uninterrupted, timely, secure or error-free, or that data, including Virtual Items, will never be lost. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Boqu Games and its affiliates, officers, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or Virtual Items, arising out of or relating to the Services or these Terms. Our total liability for all claims relating to the Services or these Terms will not exceed the greater of (a) the amount you paid for Virtual Items in the game concerned in the six months before the claim arose, and (b) USD 100.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you live in the European Union or the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

16. Indemnity

To the extent permitted by law, you agree to indemnify Boqu Games against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services. This does not apply to consumers where the law does not allow it.

17. Governing law and disputes

If you have a concern, please contact us first at [email protected]; most issues can be resolved quickly that way.

These Terms are governed by the laws of Taiwan (Republic of China), without regard to conflict-of-law rules, and the Taiwan Taipei District Court has jurisdiction over disputes arising from them. If you are a consumer, you also keep the protection of any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts there. Nothing in this section limits your right to contact a consumer protection authority.

18. Changes to these terms

We may update these Terms from time to time, for example to reflect new features or changes in law. We will post the updated Terms on this page and change the effective date above. If a change materially affects your rights, we will give notice in the game or on this website before it takes effect. If you keep using the Services after the change takes effect, you accept the updated Terms; if you do not agree, stop using the Services and delete your account.

19. General

  • These Terms, together with the documents they refer to, are the entire agreement between you and us about the Services.
  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • If we do not enforce a right straight away, we can still enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours, for example in a reorganisation or sale of our business, provided your rights are not reduced.
  • If we translate these Terms, the English version controls to the extent permitted by law.
